Court Faults Police Over “Wanted” Order, Upholds Presumption of Innocence in Bodmas Murder Case

The Coroner’s Court today heard testimonies from Civil Defence officers who exonerated Apostle Bodmas, stating that he had no contact with the deceased from the point of arrest through to the handover to the police.

Following the testimonies, counsel to Apostle Bodmas Prince Kemepadei, Barr. Arthur, urged the court to quash the police “wanted” declaration. Citing alleged complicity of the police in the matter, the lawyer argued that the police cannot act as both judge and jury in a case in which they are implicated.

Ruling on the application, the court, relying on the provisions of the State Coroner Law, granted the request and ordered the release of the detained Civil Defence officers. The court also cautioned the police against carrying out further arrests related to the matter.

The presiding judge emphasized that, under the law, no individual can be deemed guilty until proven so by a competent court of jurisdiction.
