Dagogo Drags APC to Court Over Alleged Exclusion from Contesting at 2026 National Convention

With only a few days to the forthcoming March 27 National Convention of the ruling All Progressives Congress (APC), an aspirant for the office of National Vice Chairman (South-South), Amb. Fubara Dagogo, has approached a Federal High Court in Abuja to halt all processes, following his alleged exclusion from the exercise.

Dagogo, who is the Director-General of the APC States Assembly Forum (ASAF), said in a statement on Tuesday that the party denied him nomination forms despite his payment of the mandatory N5.1 million fee and fulfillment of all other requirements to contest the election.

The aggrieved chieftain stated that after several unsuccessful attempts to obtain the nomination forms, in line with the provisions of the APC Constitution, he had no option but to seek legal redress as a committed member of the party.

In the suit marked No. FHC/ABJ/CS/591/2026, which borders on the construction and interpretation of the APC Payment Acknowledgement Receipt No. 26827 dated March 13, 2026, vis-à-vis the adjusted APC 2026 schedule of nationwide congresses, national convention and related activities—particularly the purchase of forms and dates for zonal congresses across the six geopolitical zones—as well as Section 20(1)(a) of the APC Constitution, Dagogo, as plaintiff, through his counsel, Chief (Sir) O. A. U. Onyema, Principal of Akpaagu Law House, asked the court to interpret issues arising from the matter.

Listed as defendants in the originating summons are the All Progressives Congress (APC), the National Chairman of the party, Prof. Nentawe Yilwatda; the incumbent National Vice Chairman (South-South), Hon. Victor Giadom; and the National Organising Secretary, Suleiman Mohammed Argungu.

The plaintiff, through his counsel, is praying the court to, among other reliefs, grant:

“A perpetual injunction restraining the defendants from conducting any zonal congress for the South-South APC scheduled for Thursday, March 25, 2026.

“A declaration that, by virtue of APC Acknowledgement Receipt No. 26827 dated March 13, 2026, issued to Fubara E. Dagogo, he is entitled to be issued Expression of Interest and Nomination Forms as an aspirant for the position of National Vice Chairman (South-South).

“A declaration that no APC National Vice Chairman (South-South) can validly emerge from the March 25, 2026 zonal congress when an aspirant such as the plaintiff was excluded.

“An order declaring null and void any outcome of the APC National Congress for the position of National Vice Chairman (South-South) conducted on March 25, 2026, or at any other time without the participation of the plaintiff.

“An order awarding general damages of N100,000,000 (One Hundred Million Naira) against the 3rd and 4th defendants jointly and severally for the discomfort, embarrassment and mental distress caused to the plaintiff.”

No date has, however, been fixed for the hearing of the matter.
